Following the introduction of the new General Data Protection Regulation (GDPR), we have reviewed and updated our data protection practices. We would like to assure you that Bios/Formula B.V. is fully committed to complying with all obligations and principles of the GDPR.
As part of our business relationship, we collect and store personal and company data (such as name, address, contact details (phone number, email, etc.), as well as order information (customer name, order details, delivery address, delivery date, price, payment method, etc.) in accordance with GDPR and the new German Federal Data Protection Act (BDSG).
If you have given consent to receive marketing communications, we may also use your data for promotional purposes. You can withdraw this consent at any time, after which you will no longer receive marketing materials.
We generally delete your data once the purpose for its processing has been fulfilled, unless legal retention periods require otherwise.
Please note that in the production and delivery of products, this is not considered traditional data processing. Data is only transferred to Bios/Formula B.V. to fulfill the contract, deliver the order, and, if applicable, manufacture products. Bios/Formula B.V. is responsible for these tasks in compliance with data protection laws. The legal basis for data processing in this context is Article 6 (1) (b) GDPR.
The purpose of data processing within the business relationship is solely to produce and deliver herbal mixtures or dietary supplements. The data is only used for this purpose and will not be processed further (similar to a delivery service needing addresses to fulfill deliveries). Given the importance of this matter, our legal team, including Dr. Lukas Kalkbrenner from Friedrich Graf von Westphalen & Partner mbB, has confirmed our compliance.
All employees who handle personal data are explicitly instructed and bound by data confidentiality according to Section 53 BDSG or Article 5 (1) (f) GDPR. They are informed that unauthorized collection, processing, or use of personal data is prohibited. This includes the obligation to treat any personal data and business secrets confidentially, even beyond the termination of their employment. Employees have also been advised of the legal consequences under GDPR and criminal law. We have implemented technical and organizational measures to ensure data confidentiality, integrity, availability, and resilience in accordance with Article 32 GDPR.
We would like to remind you of your rights under GDPR, including the right to access, rectify, delete, or restrict/block data processing. You also have the right to lodge a complaint with a data protection authority.
